The Public Works Act 1981 provides for the payment of compensation for losses arising from the acquisition of land by an Acquiring or Requiring Authority. The intent is to ensure an affected land owner is left in a ‘no better-no worse’ position than they would have been had the acquisition not taken place. For local authorities, government agencies and network utility providers we provide assessments of the likely compensation payable.
For individuals affected by a proposed public work such as roading, rail, electricity, or water infrastructure, you are entitled to obtain your own independent valuation advice from an independent Registered Valuer. Section 66 of the Public Works Act 1981 allows for reimbursement of reasonable valuation and legal fees or costs incurred in respect of the land taken or acquired.
